Agreement Between User and Aegio LLC

Welcome to Aegio. The Aegio website (the “Site”) is comprised of various web pages operated by Aegio LLC (“Aegio”).

Aegio is offered to you conditioned upon your acceptance, without modification, of the terms, conditions, and notices contained herein (the “Terms”). Your use of Aegio constitutes your agreement to all such Terms. Please read these Terms carefully and keep a copy for your reference.

Aegio is a child monitoring platform.

1. Legal Use Only

Aegio provides tools solely for parents and legal guardians to monitor their own minor children and their devices.

By using Aegio, you agree that:

  • You will not use Aegio to monitor any adult, spouse, partner, employee, roommate, or any individual over whom you do not have legal monitoring authority.
  • You will not use Aegio for covert, surreptitious, or non-consensual surveillance.
  • You will comply with all federal, state, and local laws relating to monitoring, data collection, recording, and privacy.

Aegio LLC is not responsible for your use of the software in any unlawful manner. You accept full responsibility for ensuring your use complies with the laws of your jurisdiction.

2. Data Collected by the Service

Aegio and its platform components collect, store, and analyze telemetry and other data from connected devices, which may include:

  • Location
  • Photos, videos, and audio (if enabled)
  • Call logs
  • Text messages and messaging metadata
  • Application usage
  • Device notifications
  • DNS and web activity
  • Other device telemetry

You acknowledge that this data may include sensitive personal information, including faces, voices, minors, and private environments captured in photos or videos.

3. Video & Audio Recording — State Law Compliance

If you enable photo, video, or audio recording features, you agree and acknowledge:

  • Recording laws vary by state. Some states require all parties to consent to audio or video recording (“Two-Party Consent States”), including:
  • California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania, Washington.
  • You will only record your own minor child and will ensure your child is informed where legally required.
  • You will not record teachers, school staff, other students, bystanders, family members, or any person who is not your minor child unless such recording is lawful.
  • You assume full legal responsibility for complying with applicable recording and privacy laws.

Aegio LLC disclaims all liability for any recordings made or stored in violation of applicable law.

4. Biometric Information Warning

Videos and images may contain biometric identifiers (such as faces). Some states regulate biometric information, including:

  • Illinois (BIPA)
  • Texas
  • Washington
  • Colorado

By enabling video features, you consent to Aegio storing such media for parental monitoring purposes only.

Aegio does not perform biometric identification, facial recognition, or analysis.

5. Privacy Policy

Your use of Aegio is subject to the Aegio Privacy Policy. Please review the Privacy Policy, which governs the Site and explains our data collection and processing practices.

6. Electronic Communications

Visiting Aegio or sending emails to Aegio constitutes electronic communications. You consent to receive such communications, and you agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

7. Your Account

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your devices. You agree to accept responsibility for all activities that occur under your account.

You may not transfer your account to another person or entity. Aegio is not responsible for unauthorized access to your account resulting from theft or misappropriation.

Aegio reserves the right to refuse or cancel service, terminate accounts, or remove or edit content at its sole discretion.

8. Children Under Thirteen

Aegio collects personal information from children under 13 only with verified parental consent and solely for parental monitoring.

Parents and guardians are responsible for:

  • Ensuring they are the legal guardian of the monitored child
  • Understanding what data is collected
  • Ensuring lawful use of monitoring tools

If you are under 13, you must have a parent or guardian’s permission to use this website.  
If you are under 18, you may use the platform only with permission of a parent or guardian.

9. Links to Third-Party Sites

The Site may contain links to external websites (“Linked Sites”). Aegio is not responsible for the content of any Linked Site, nor any changes or updates to such sites.

Certain services may be provided through third-party organizations. By using such services originating from the Aegio domain, you consent to allowing Aegio to share information with third-party providers as needed to deliver requested services.

9a. Use of Third-party for Moderation

Aegio utilizes third-party content moderation services to detect unsafe or inappropriate material. User content may be securely transmitted to third-partys for automated analysis.

The third-party acts solely as a data processor and does not retain or use the data for any purpose other than moderation.

10. No Unlawful or Prohibited Use / Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms.

As a condition of your use of the Site, you warrant to Aegio that you will not use the Site for any purpose that is unlawful or prohibited by these Terms.

You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site.

You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Site.

All content included as part of the Service, such as text, graphics, logos, images, and software, is the property of Aegio or its suppliers and is protected by copyright and other intellectual property laws.

You agree not to modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part.

You do not acquire any ownership rights in any protected content.

11. International Users

The Service is controlled and administered by Aegio from within the United States. If you access the Service from outside the U.S., you are responsible for compliance with all local laws.

You agree not to use Aegio in any country or jurisdiction where such use is illegal or prohibited.

12. User Responsibility for Legal Compliance

You acknowledge and agree that:

  • Aegio LLC does not provide legal advice.
  • Laws regarding surveillance, monitoring, data collection, and recording vary widely by state and country.
  • You are solely responsible for ensuring your use of Aegio is lawful where you and the monitored device are located.

Aegio LLC expressly disclaims responsibility for any unlawful use of the platform by its users.

13. Automated Analysis & Mandatory Reporting

We use automated systems, including AI-based analysis, to help detect content that may involve abuse, exploitation, or endangerment of minors.If our systems detect content that may involve the sexual exploitation or abuse of a minor, we are legally required to restrict access to that content and report it to the National Center for Missing & Exploited Children (NCMEC).Such content is quarantined and is not made available to users, including parents or guardians. Reports may be submitted without notice, as required by law.Where required by law, we report suspected child sexual exploitation or abuse to the National Center for Missing & Exploited Children (NCMEC) and, when appropriate, to law enforcement agencies.

14. Indemnification

You agree to indemnify, defend, and hold harmless Aegio LLC, its officers, directors, employees, agents, and third parties, from any losses, costs, liabilities, and expenses (including reasonable attorney’s fees) arising out of:

  • Your use or inability to use the Site or services
  • Any recordings or data collected through the platform
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your violation of any applicable laws

Aegio reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you.

15. Arbitration

Any dispute arising out of or related to these Terms shall be resolved by binding arbitration pursuant to the Federal Arbitration Act, administered by the American Arbitration Association, before a single neutral arbitrator.

The arbitrator’s decision shall be final. Judgment on the award may be entered in any court with jurisdiction.

The prevailing party is entitled to recover reasonable attorney’s fees and costs.

16. Class Action Waiver

All arbitration under these Terms must be conducted on an individual basis. Class arbitrations, class actions, and collective actions are not permitted.

You agree that claims may only be brought in your individual capacity.

17. Liability Disclaimer

THE SITE AND ALL INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND.  
AEGIO LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AEGIO LLC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA OR PROFITS, ARISING FROM THE USE OR PERFORMANCE OF THE SITE.

18. Termination / Access Restriction

Aegio reserves the right, in its sole discretion, to terminate your access to the Site and services at any time, without notice.

This agreement is governed by the laws of the State of Arkansas.

19. Changes to Terms

Aegio reserves the right to modify these Terms at any time. The most current version supersedes all previous versions.
